Klickachef Terms of Use

Effective Date: 14th January, 2025

Introduction:

Welcome to Klickachef, a food delivery platform designed for working professionals. By accessing or using Klickachef, you agree to comply with and be bound by these Terms of Use. Please read them carefully. If you do not agree to these terms, you may not use the platform.

1. Definitions

"Platform" refers to the Klickachef website, mobile applications, and associated services.

"Users" refers to all users of the platform, including restaurants, delivery partners, and customers.

"Restaurant" refers to food vendors, restaurants, or catering establishments that list and sell food on Klickachef.

"Delivery Partner" refers to individuals or entities that deliver food to customers on behalf of restaurants.

"Customer" refers to individuals or entities who place food orders on Klickachef.

2. Eligibility

To use Klickachef, you must:

  • Be at least 18 years old.
  • Provide accurate, up-to-date, and complete information when creating an account.
  • Comply with all applicable laws and regulations.

3. Account Responsibilities

  • Account Creation: You must create an account to use Klickachef services. You are responsible for maintaining the confidentiality of your account login information.
  • Account Security: You agree to notify Klickachef immediately of any unauthorized use of your account. Klickachef is not liable for any loss or damage from your failure to protect your account credentials.

4. User Obligations

4.1. For Restaurants:

  • Menu & Pricing: You are responsible for accurately listing your menu items, including ingredients, pricing, and availability.
  • Order Fulfillment: You agree to prepare and fulfill orders in a timely and professional manner.
  • Compliance: You must ensure compliance with all relevant health, safety, and food hygiene regulations.
  • Communication: You agree to maintain clear communication with customers and delivery partners to ensure smooth order fulfillment.
  • Payment Terms: Klickachef will pay you based on the agreed commission structure after deducting applicable fees.

4.2. For Delivery Partners:

  • Delivery Obligations: You agree to accept and complete delivery orders in a timely manner, using the most efficient route possible.
  • Safety & Conduct: You must comply with all road safety regulations and behave professionally with restaurants and customers.
  • Payouts: Delivery partners will receive payment for deliveries completed, subject to Klickachef’s commission and payout schedule.
  • Insurance: You are responsible for ensuring your vehicle is insured and legally compliant for delivery purposes.

4.3. For Customers:

  • Order Placement: By placing an order, you agree to pay the total amount, including food costs, service fees, and delivery charges.
  • Order Accuracy: You must provide accurate delivery details (name, address, phone number) and payment information.
  • Communication: You agree to respond promptly to delivery partner communication to facilitate smooth delivery.
  • Refunds & Cancellations: Refunds and cancellations are subject to Klickachef’s cancellation and refund policy.

5. Payments

  • For Restaurants: Klickachef deducts a commission from each sale before transferring payouts to the restaurant.
  • For Delivery Partners: Klickachef deducts a commission from each delivery fee before transferring payouts to delivery partners.
  • For Customers: Customers are required to pay for their orders via digital payments or other authorized methods when placing an order.

6. Commission & Service Fees

Klickachef charges the following fees:

  • Restaurants: Percentage commission on each order.
  • Delivery Partners: Percentage commission on delivery fees.
  • Customers: Flat-rate service fee on each order.

These fees may be adjusted, and any changes will be communicated via email or app notification.

7. Order Fulfillment and Delivery

  • For Restaurants: You must prepare the orders as soon as they are placed and have them ready for the delivery partner to pick up.
  • For Delivery Partners: You must pick up and deliver orders within the specified delivery timeframe.
  • For Customers: You are responsible for being available at the delivery location to receive the order. If you are not available, additional charges or order cancellation may occur.

8. Cancellations and Refunds

8.1. For Customers:

  • Order Cancellations: You may cancel an order before it is confirmed by the restaurant. Once an order is confirmed, it cannot be canceled without incurring a charge.
  • Refunds: Refunds will only be issued for orders that were not fulfilled, for items that were incorrect, or for reasons outlined in our refund policy. Refund requests must be made within 24 hours of delivery.

8.2. For Restaurants:

  • Cancellations: Restaurants may cancel orders if they are unable to fulfill them due to unforeseen circumstances. Restaurants must notify Klickachef and the customer immediately.

8.3. For Delivery Partners:

  • Cancellations: Delivery partners may only cancel delivery assignments in cases of emergencies. Frequent cancellations may result in account suspension or termination.

9. Intellectual Property

All content on the Klickachef platform, including logos, images, and software, is the intellectual property of Klickachef or its licensors. You are not permitted to use, reproduce, or distribute any content without our express written consent.

10. User-Generated Content

  • Reviews & Ratings: Customers may leave reviews and ratings for restaurants and delivery partners. These must be truthful and respectful. Klickachef reserves the right to remove any offensive or misleading reviews.
  • Feedback: Any feedback, suggestions, or ideas you provide to Klickachef may be used for product improvement and service development.

11. Limitation of Liability

Klickachef is a platform that connects restaurants, delivery partners, and customers. We are not responsible for:

  • The quality, safety, or legality of food provided by restaurants.
  • The conduct of delivery partners or their ability to complete deliveries.
  • Any personal injury or property damage resulting from the use of the platform.

In no event will Klickachef be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the platform.

12. Account Suspension & Termination

Klickachef reserves the right to suspend or terminate any account without notice if:

  • The user violates these terms.
  • The user engages in fraudulent or illegal activity.
  • The user’s actions harm Klickachef’s reputation or user base.

13. Amendments to the Terms

Klickachef may modify these terms at any time. Users will be notified of any significant changes via email or in-app notifications. Continued use of the platform after changes have been made indicates acceptance of the updated terms.

14. Governing Law

These Terms of Use are governed by the laws of Kenya. Any disputes arising from these terms will be resolved through mediation. If mediation fails, disputes will be subject to the exclusive jurisdiction of the arbitration process and shall take place in Nairobi, Kenya.
